Hazardous Substance Control

Exposure to dangerous chemical substances in consumer products is of great concern to consumers, retailers, and law makers. In addition to posing serious health risks to the general public these chemicals are toxic to the environment. Fortunately, new regulations are appearing with regular consistency from various nations around the world. However, since there is a lack of regulatory harmonization between countries it is imperative to implement a comprehensive Restricted Substance Policy (Restricted Substance List) for Substances of Very High Concern (SVHC). MTS provides practical solutions throughout all aspects of the supply chain for managing such programs including consulting, factory assessments, socially responsible sourcing audits, product, and packaging testing.

Examples of Existing Legislation

As an example, in the state of California, Proposition 65 (formally titled "The Safe Drinking Water and Toxic Enforcement Act of 1986") requires the State to publish a list of chemicals known to cause cancer or birth defects or other reproductive harm. This list, which must be updated at least once a year, has grown to include approximately 800 chemicals since it was first published in 1987.

Some additional regulations, legislation, and directives include:

  • United States Consumer Product Safety Improvement Act (CPSIA)
  • US Food & Drug Administration (FDA)
  • Toxicological Risk Assessment (TRA) and Labeling of Hazardous Art Materials Act (LHAMA)
  • EU Restriction on Hazardous Substances in electrical products (RoHS)
  • EU Toy Safety Directive (2009/48/EC)
  • EU Regulation on Registration, Evaluation, Authorization and Restriction of Chemicals (REACH)
  • Canada Consumer Product Safety Act (CCPSA)
  • China’s National General Safety Technical Code for Textile Products (GB18401)
  • Australia Competition and Consumer Act 2010 (Trade Practices Act 1974)
